nah. .08 is the limit. If that's your BAC, then you are breaking the law, but just barely.

The potential for alcohol poisoning arises if your BAC is around .13. Anything higher is potentially fatal for some people. It depends on brain chemistry. The definitive hard-line number that will poison anyone is .16.... that's what's in my old drivers ed manual, anyway  :D

Until fairly recently the usual legal limit was 1.0, so no, that's not very high.

.13 seems awfuly low for potential alcohol poisoning, mostly because one of friends has a breathalyzer and .13 is right around when were starting to get drunk, and if .16 will poison me, then I guess my body has been destroyed quite a bit haha.  We are college kids, so we do probably drink too much but still.  Also, I'm surprised that if his BAC was at .08 he was actually arrested.  .08 for a guy his size is probably 4 beers or so, which really shouldn't affect one's driving.

oh MBz - BAC "for a guy his size" doesn't work.  BAC factors in your size (It's Blood Alcohol Content, meaning the ratio of alcohol in your blood).  But yes, a .08 might have been a six pack for him. 

And I feel you on the alcohol poisoning statement... really a mild case of alcohol poisoning is just called being drunk.  That's what alcohol does, it poisons you.

All I can say is I lived in Maricopa county a couple years ago.  Some of those roads (particularly in an area that would be enforced by a Pima-Maricopa Indian Community police) officer are a little rough, and very desolate.  He still made a dumb decision just because a guy like him can afford a driver, but it's not the same as getting liquored up and driving in a school zone.

i got a DUI when I was 19 and blew a .16, it's on the high side but I remember everything and definitely don't think I was "alcohol poisoned". 

I remember, I think it was Jeff Garcia several years ago had a DUI and blew like .24, now that is high.  He was driving the wrong way down a one-way street and was swerving to avoid curbs when the cops found him.

either way not cool and I'm sure david stern will have something to say about it.

Lets not get too wrapped up in the numbers here.  The fact is, .08 is the legal limit, and has been proven to be intoxicated to the point where it makes you an unsafe driver.

is it that hard to get a ride from someone if you decide to drink?  i HATE intoxicated drivers....they put so many innocent people at risk.

In most US cities there are services for people that drink n drive...one i know of is called "Tipsy Taxi"that specializes in picking up people who are intoxicated and don't want to drive their vehicle.All it takes is a phone call.C.Barkley better add one to his fav.five next time.

The article just said he was accused of having a blood alcohol level above .08, not that it was at .08.  So all the reporter knows now, or at least what he's accused of, is that he was over the legal limit.
